MY WIFE'S 2010 PRIUS OCCASIONALLY SURGES FORWARD WHEN THE BRAKES ARE APPLIED. THIS TYPICALLY OCCURS WHEN DRIVING DOWN HILL AND OVER BUMPS. IT HAPPENS ABOUT 1 TIME PER 14 DAYS. THE SURGE IS ONLY FOR A SPLIT SECOND. CONTROL OF THE CAR HAS NOT BEEN LOST YET. NOTHING HAS BEEN DONE TO FIX THE PROBLEM

THE BRAKES ON MY 2010 TOYOTA PRIUS AT TIMES DO NOT ENGAGE IMMEDIATELY. IT MAY BE NECESSARY AT THOSE TIMES TO DEPRESS THE BRAKE PEDAL BY 1/3RD BEFORE BRAKING BEGINS. THERE IS A SIMILAR DELAY WHEN BRAKING IS USED TO TURN OFF CRUISE CONTROL. NEITHER OF THESE HAVE CAUSED AN ACCIDENT, BUT IN BOTH CASES THERE IS SOME RISK.

2010 TOYOTA PRIUS BRAKING PROBLEM. GOING DOWN STEEP LONG HILL, WITH ROUGH SURFACE, WE ENCOUNTER THIS PROBLEM 1 OR 2 TIMES A WEEK, REPEATEDLY. IT FEELS LIKE WE ARE "FLYING" DOWN THE HILL BRIEFLY, OUT OF CONTROL, WHILE IN FACT, WE ARE GOING APPROXIMATELY 15 MILES PER HOUR AND ARE APPLYING THE BRAKE IN THE SAME MANNER AS ALWAYS. THIS IS VERY SCARY, AS THE HILL HAS A HUGE DEEP RAVINE ON ONE SIDE, AND A HIGH CLIFF ON THE OTHER SIDE, AND A CLIFF OFF A BEACH INTO THE SALT WATER AT THE BOTTOM OF THE HILL. THE ROAD IS VERY NARROW, WITH 2 VEHICLES GOING UP AND DOWN ONLY ABLE TO PASS AT SELECTED POSITIONS, OTHERWISE, ONE LANE TRAFFIC. PLEASE DEMAND THAT TOYOTA RECALL THIS VEHICLE, AND REPLACE THE SOFTWARE THAT CONTROLS THE BRAKING SYSTEM. I UNDERSTAND FROM THE NEWS THAT THEY HAVE THIS FIX IN PLACE ON NEW CARS SINCE LAST MONTH. PLEASE RECALL THIS VEHICLE ASAP! MY VEHICLE NUMBER IS [XXX] PRODUCTION DATE 6/09. THANK YOU. INFORMATION REDACTED PURSUANT TO THE FREEDOM OF INFORMATION ACT (FOIA), 5 U.S.C. 552(B)(6). *TR

DEAR SIR, I WOULD LIKE TO BRING A PROBLEM TO YOUR ATTENTION. I PURCHASED A 2010 TOYOTA PRIUS, VIN# [XXX] , IN JUNE 2009. THE PROBLEM IS NOT THE BRAKE PROBLEM BEING DESCRIBED IN THE PREDICTED RECALL. MY PROBLEM IS AS FOLLOWS: WHEN THE VEHICLE IS DRIVEN AND THEN PARKED (SHUT DOWN ) AND STARTED AGAIN, THE BRAKES WILL LOCK UP AT THE SLIGHTEST PRESSURE ON THE BRAKE PEDAL. WHEN STARTING OUT OF A PARKING SPOT, EITHER FORWARD OR BACKWARD, THE SLIGHTEST TOUCH OF THE BRAKE PEDAL WILL LOCK THE BRAKES AND STAND THE CAR ON IT'S NOSE. I HAVE FOUND THAT IF THE PROBLEM OCCURS, I CAN EITHER STOP THE VEHICLE ( SHUT OFF WITH THE START BUTTON ) OR HOLD DOWN HARD ON THE PEDAL FOR 10 TO 20 SECONDS, THE BRAKES PERFORM NORMALLY. I RETURNED THE VEHICLE TO THE DEALER IN AUGUST 2009 FOR AN OIL CHANGE AND REPORTED THE PROBLEM, BUT THE SERVICE DEPARTMENT DISMISSED THE COMPLAINT AS 'COULD NOT DUPLICATE THE COMPLAINT' EVEN THOUGH I EXPLAINED THAT IT DID NOT OCCUR EVERY TIME. I CAN NOT CONNECT THE PROBLEM WITH ANY PARTICULAR SITUATION. IT CAN OCCUR WITH NORMAL DRIVING OR IN ECO MODE. I FEEL IT IS AN ANNOYANCE MORE THAN ANYTHING ELSE, BUT COULD POSE A PROBLEM IN CERTAIN CIRCUMSTANCES. I WILL GLADLY ANSWER ANY QUESTIONS YOU MAY HAVE REGARDING THIS PROBLEM. On September 30, 2019, ODI opened Defect Petition DP19-004 to evaluate the petitioner?s request for an investigation. In August 2020, the petitioner notified the Agency that he was withdrawing his petition. Because the petitioner has withdrawn the petition, we are denying the petition as moot and no further analysis of this petition is necessary.NHTSA is authorized to issue an order requiring notification and remedy of a defect if the Agency?s investigation shows a defect in the design, construction, or performance of a motor vehicle that presents an unreasonable risk to safety. 49 U.S.C. ?? 30102(a)(9), 30118. Because the petitioner has with withdrawn the petition, the petition is denied as moot. This action does not constitute a finding by NHTSA that a safety-related defect does not exist. The Agency notes that it is not required to receive a defect petition prior to opening a defect investigation and will take further action if warranted by future circumstances.

The subject vehicles are the first model year of a new design generation of the Prius model line. The vehicles are powered by a hybrid drive system that uses both a regenerative braking system, which converts vehicle momentum into electrical energy to be stored in onboard batteries, and a hydraulic brake system more typical of the brake system used on non-hybrid vehicles. As is the case for other similarly designed hybrid vehicles the interaction and management of the two braking systems during ABS braking is complex and requires a sophisticated control system. In a February 9, 2010 Defect Information Report, Toyota advised the agency of its plans to conduct a safety recall to address inconsistent brake feel and increased stopping distances that may occur during braking events requiring ABS operation, such as would occur when braking on rough or low friction road surfaces.Toyota will reprogram the ABS control unit with improved software that addresses this condition.Based on Toyota's action the investigation is closed. ODI will continue to monitor the subject vehicles' performance and will take further action as future circumstances dictate.
