# **NHTSA Complaint Answers** ### **1. What component or system failed or malfunctioned, and is it available for inspection upon request?** The **engine** failed due to **sudden and extreme oil consumption** that resulted in the engine being completely dry of oil despite regular maintenance. This caused internal damage including **CVVT (Continuous Variable Valve Timing) system failure**, bearing damage, and a complete engine seizure. Yes, the failed engine is fully available for inspection upon request. The vehicle is currently located at Dick Smith Hyundai in Greenville, South Carolina, where the dealership diagnosed the failure and recommended a full engine long block replacement. ### **2. How was your safety or the safety of others put at risk?** The engine failure occurred **suddenly and without warning**, causing the vehicle to lose power while operating. The loss of engine function created the risk of: * sudden deceleration in traffic, * inability to accelerate or maneuver, * potential rear-end collision, * complete engine stall in unsafe conditions. The vehicle had **no oil warning light** prior to the failure, meaning I had no indication that the engine was at risk until the failure occurred. ### **3. Has the problem been reproduced or confirmed by a dealer or independent service center?** Yes. The engine failure was confirmed by: • **Schwab’s Automotive** in Fayetteville, NC – determined the engine suffered catastrophic internal damage and was not repairable. • **Dick Smith Hyundai** dealership – confirmed **high oil consumption and CVVT damage**, and recommended a full **engine long block replacement** (estimate: $8,160.60). The problem has been fully verified by both an independent mechanic and an authorized Hyundai dealership. ## **4.Yes.The vehicle was formally inspected by Hyundai Motor America through the dealership’s diagnostic report. The car has been consuming all the engine only after 700 miles. This has been a constant issue since December 2024 and the issue has been brought up with Hyundai dealership in Denville, NJ and Hyundai Corporate as well. Hyundai dealership in Denville, NJ performed 2 oil consumption tests, which the vehicle failed both test only after 700 miles as it consumed all the engine oil. They refused to do further investigation or recall the engine as it should be covered under Hyundai TXXI warranty given the Hyundai Engine II Class Action Settlement a few years ago. The vehicle has broken down on me on the highway a few times and has put my family at risk and danger due to the negligence of the Hyundai dealership in Denville, NJ and Hyundai Corporate refuel to resolve the issue. Now the car does not start at all some days thus it has impacted my work and my ability to provide for my family

The repair recommendations were as followed: ensure connecting rod bearings are within spec, recommending performing timing job w/replacement of intake camshaft, e-cvvt motor/gear, e-cvvt cover, and other components necessary for repairs. This engine burns/consumes oil and the engine code that shows up in P00100. All of this after I paid it off. Not within warranty anymore either. $22,000 down the drain it seems... called hyundai customer service to see if there was anything that could be done but they said there is nothing they can do and I have to fix it even though it is a manufacturing issue.

Was going down the highway at 65 when my vehicle completely lost the accelerating component. Almost got rear ended so I pulled off. Then made it to work when it happened again. The engine light came on and gave 2 codes. Finally got it towed to the dealership where they have decided it’s either a new timing chain or new engine due to mechanical loss. They discovered there was no oil in the car and they have also found metal shavings in my oil. Now they are telling me I need a whole new engine. I only have 124000 miles on this car. The car was driving perfectly fine the day before and had just been to the dealer and looked over 1,500 miles before and I was told everything was perfect working condition. I am out $4000 on a car I bought a year and a half ago in October 2023.Was told my warranty only lasted a year.

I check my oil once a week to make sure I have adequate oil to ensure my engine doesn't blow, Hyundai has open recalls on the 2017 models of my vehicle but my VIN number is not included...I have complained to Hyundai corporate and also the dealer and they state that I have to do an oil consumption test, at cost to me, to prove that their engine is defective...I first noticed this issue about 1 month after I purchased my vehicle, I was driving and my oil light flashed on for less than a second, I stopped at my sisters house and let my engine cool down and checked my oil and there was absolutely none... I refilled it and then began checking my oil weekly. I add at least 1/4-1/2 quart per week between oil changes. Every time I take my car in for an oil change they have to add an extra quart and make me aware that my vehicle is burning a significant amount of oil... This is my everyday car, I use it to get back and forth to work, I transport my children in this vehicle. There is a 953 Recall and also 218 but my VIN is not included.

In June 2024, my vehicle suddenly lost power while I was driving on the freeway, almost causing a serious accident. I managed to restart the car after being stuck on the shoulder of the freeway for several minutes. The same issue occurred the following day, prompting me to have the vehicle towed to the dealership. Hyundai Motor was contacted since the vehicle is still under warranty. The dealership informed me they would conduct an oil consumption test three times to diagnose the issue. However, they also stated that for the test to be successful, I needed to replace unrelated parts, including the brakes and transmission oil, among other items. Reluctantly, I agreed and spent $1,800 on these replacements. After completing the first oil consumption test, I returned for the second test. However, the dealership informed me that no further tests were necessary and returned the car to me without addressing the underlying issue. I emailed the case manager assigned by Hyundai to report this, but I never received a response. A few months later, the car failed to start. I contacted Hyundai again, and they dispatched a tow truck. The tow truck driver managed to start the car. A few days later, the issue recurred, and the roadside assistance tow driver suggested it might be the battery. Out of frustration, I paid $300 to replace the battery. Despite this, the car continued to make unusual noises at startup, a problem I had repeatedly mentioned to the dealership and in my communications with Hyundai. The situation reached a critical point today when my wife was driving the vehicle on the freeway with our five children inside. While traveling at 60 miles per hour, the car suddenly lost power again, putting their lives in danger. This is the third time this hazardous issue has occurred, and I fear for the safety of my family.

Which is not much, in the past one year i have noticed that engine oil is burning faster than usual. On every oil change after driving between 1200 and 1500 miles the oil engine sign blinks and upon checking needed 2 Quarts of oil. I spoke the dealership and they are not very helpfull. Also they did the oil combustion test which i was charged. Later i was advised to do. ("Good morning, Just got off the phone with you sir warranty won't cover it due to the vehicle being out of manufacture warranty and mileage. My technician recommended starting with combustion chamber cleaning which would be around 1200 before taxes and shop supplies. Combustion chamber cleaning is the process of removing carbon buildup from the combustion chamber and intake valves of a fuel-injection engine. to see if that fixes the problem that you are having with the car burning oil. If that step doesn't work we we would submit a warranty pa again, to see if they would cover a new engine." Please advise what should be my next step, as per my mechanic the only solultion right now i have is keep adding oil carefully.

While driving on rural side road, two lanes, my check engine light (yellow, steady) came on. I pulled into a safe spot and did a quick survey, checked the owner manual, but could not identify any problem, and continued on my way. The check engine light was still on. About 15 minutes later the car would not accelerate past 25 mph (limp mode?). I was on a two-lane mountain road, speed limit 45 (but most cars were faster), visibility limited by terrain, trees, etc. Again, there was little traffic around me and I found a safe place to pull over. in neutral the engine revved normally. I turned the ignition off, checked oil level, (normal), turned the engine back on and started driving to find a safe place to pull over and summon help, but the car drove normally. I drove directly to my repair shop and had the codes pulled, (0436, 0021) which indicate a problem with timing. When a qualified tech examined it he recommended taking to the dealer. Unwilling to drive in traffic, I had it towed to the dealership. Their inspection revealed damage to CVVT components and the timing chain, and recommend an (expensive) engine rebuild.

3DP24001 · 3.3L Engine Loss Of Motive Power (lomp)
Opened Feb 8, 2024 · Closed May 16, 2024
Status: closed (inferred from source dates) · Engine
The Office of Defects Investigation (ODI) received a petition on February 2, 2024, requesting a defect investigation into an alleged defect of the "engine" on the following vehicle model: 2017 Hyundai Santa Fe vehicles equipped with the 3.3L V-Shaped GDI Lambda-II engines. The petition cites allegations of a loss of motive power, often resulting in an engine seizure. The stall is preceded by a knocking sound, decreased performance and no warning lights. An analysis of the subject vehicle population was undertaken using complaints submitted to ODI along with manufacturer data. It was determined that the frequency of events is low for the subject population, while those that specifically report a loss of motive power event have a high mileage at the time of incident. The 2017 Santa Fe is equipped with a service interval reminder for the consumer that must be set by the consumer themselves or at a dealership. A Technical Service Bulletin (19-EM-002H) instructs the dealership to set the maintenance reminder at the completion of routine maintenance service or anytime a repair is performed that requires new engine oil. This maintenance reminder will help reinforce the need for proper oil maintenance intervals. Additionally, the Santa Fe vehicles with 3.3L V-shaped Lambda-II engines will be added to Hyundai’s existing Technical Service Bulletin (23-EM-007H) related to combustion chamber cleaning. These actions will help limit negative consumer incidents related to loss of motive power. Lastly, Hyundai has extended the limited engine warranty for MY 2013-2019 Santa Fe vehicles equipped with 3.3L V-shaped Lambda-II engines included in the Petition. The updated coverage is 15 years, or 150,000 miles and details are contained in Technical Service Bulletin 24-EM-003H. In view of the service interval reminder, combustion chamber cleaning, and extended warranty actions being taken by Hyundai, ODI is denying this Defect Petition. The agency reserves the right to take additional action if warranted by future circumstances. To review the report cited in the Closing Resume ODI Report Identification Number document, go to NHTSA.gov.

DP22003 · Loss Of Motive Power
Opened Sep 12, 2022 · Closed Dec 12, 2023
Status: closed (inferred from source dates) · Engine
The National Highway Traffic Safety Administration (NHTSA) received a letter dated July 13, 2022, petitioning the Agency to initiate a safety defect investigation into loss of motive power allegations attributed to oil drain pan assembly failures on certain Hyundai Motor America, Inc. and Kia America, Inc. vehicles spanning Model Years (MY) 2005-2021. The Petitioners cited examples of complaints indicating that the subject vehicles were experiencing rapid loss of engine oil due to oil drain plug back outs, resulting in loss of motive power and/or catastrophic engine damage. Additional complaints were provided which alleged that the oil drain pans lack sufficient structural integrity and are susceptible to cracking. The petition itself can be reviewed at NHTSA.gov under ODI number 11481745. On September 12, 2022, the Office of Defects Investigation (ODI) opened Defect Petition (DP22-003) to evaluate the Petitioners’ request. The Petitioners have provided additional complaints within four supplemental letters dated January 31, 2023, March 21, 2023, May 23, 2023, and August 4, 2023. ODI’s evaluation included the review and analysis of the complaints and supporting information submitted by the Petitioners, as well as additional complaints submitted directly to NHTSA which referenced either the oil drain plug or a crack in the oil pan. After reviewing the available data, ODI has not identified evidence that would support opening a defect investigation into the oil drain pan assemblies of the subject vehicles. Based on a review of the available information, a loss of motive power resulting from an oil drain plug back out has not occurred between the initial sale of a vehicle and the completion of its first oil change. If during an oil change service, a technician fails to remove the existing drain plug gasket before installing a new gasket, it is likely that a proper seal between the drain plug and the oil pan will not be made. An improper seal between the drain plug and oil pan could lead to the backing out on the drain plug, resulting in the sudden loss of oil while driving. Additionally, the provided examples of oil pan cracks were localized to the immediate vicinity of the oil drain plug and/or appeared to be the result of direct-contact with a tool during servicing. There is no information to support that a vehicle-based defect exists relating to the oil pan assembly, and instead the documented incidents are related to the failure to follow the proper maintenance procedures during oil change service. In October 2023, Hyundai published a Technical Service Bulletin (TSB) that provided detailed instructions for oil change service on its gasoline powered vehicles, specifically highlighting the need to remove and replace the existing drain plug gasket prior to reinstalling the drain plug. After a thorough review of the material submitted by the petitioner, the information already in NHTSA's possession, and the potential risks to motor vehicle safety implicated by the petitioners' allegations, NHTSA does not believe that a formal investigation is warranted. Therefore, the petition is denied. A Federal Register Notice (FRN) further detailing NHTSA’s reasons for denial of the petition will be published. The reference numbers for the complaints to NHTSA cited by the petitioner can be found in the petition submission documents in the public file for DP22-003. To review those complaints and the additional complaints ODI added to its evaluation which are cited in the Closing Resume ODI Report Identification Number document, go to NHTSA.gov.
