Federal Safety Recall Fraud and Vehicle Endangerment Report Vehicle: 2022 Hyundai Elantra Blue Hybrid | Involved Dealerships: Earnhardt Hyundai North Scottsdale & Larry H. Miller Hyundai Peoria This complaint documents severe federal safety recall fraud and mechanical endangerment by authorized manufacturer franchise dealerships. In April 2025, Earnhardt Hyundai took physical possession of my vehicle for a federally mandated Hydraulic Electronic Control Unit (HCU) braking/cruise control safety recall. Staff verbally verified the recall was complete, but the physical invoice and subsequent written email admission from Service Drive Manager [XXX] confirmed the safety repair was completely omitted with "no excuse."To resolve this braking risk, on April 22, 2026, I brought the vehicle to Larry H. Miller Hyundai Peoria to have the uncompleted HCU safety recall corrected. Subsequently, on June 17, 2026, I returned to the Peoria facility for a warranty deck lid repair and a scheduled oil change.Upon releasing the vehicle on June 17, the Peoria service department actively jeopardized my hybrid engine integrity by installing an incorrect, out-of-spec oil fluid weight (5W30) and releasing the vehicle with a completely loose, unsealed engine oil cap. This gross negligence forced me into a dangerous 140-mile high-altitude mountain highway transit ([XXX] to Flagstaff) with a compromised engine bay, creating an immediate engine fire hazard and risk of sudden highway power failure. The loose cap and incorrect fluid were independently verified and caught on video by Milestone Auto Repair in Flagstaff.The manufacturer's franchise network is falsifying federally mandated safety recall records and releasing vehicles in life-threatening, non-compliant conditions. I am reporting a safety-related defect involving the vehicle’s infotainment and forward safety systems. When this occurs, the vehicle also shows a “Check Forward Safety System” warning message. Diagnostic trouble code C162078 is triggered, indicating a front radar out of alignment. As a result, critical safety features such as Forward Collision-Avoidance Assist, Smart Cruise Control, and other radar-based driver assistance systems are disabled. This issue creates a significant safety risk because the driver is not alerted to potential forward collisions and cannot rely on active safety systems. The blank infotainment screen also prevents access to vehicle settings, warnings, and camera functions. In South Korea, this same defect has resulted in an official recall and free front radar replacement and calibration. However, in the United States, customers are not covered under a recall and are required to pay out of pocket for radar realignment or replacement, even though the issue is identical and a lot of time the issue came back 3 months later and customer have to pay out of pocket once again to fix the same issue. Many owners report receiving official recall notices in other markets, while U.S. owners must independently diagnose the issue. Dealers often state that the problem may be caused by radar misalignment after a software update or system fault. In some cases, cleaning or recalibration temporarily resolves the issue, but in other cases, full radar replacement is required. This inconsistent treatment places U.S. consumers at a financial disadvantage and allows a known safety defect to remain unresolved. I am requesting that NHTSA investigate this defect and require the manufacturer to issue a U.S. recall with free repair, calibration, or replacement, consistent with actions already taken in other countries.

My vehicle experienced a sudden and complete brake assist failure, including the emergency brake. I was unable to stop the vehicle, which directly resulted in a collision. Prior to the crash, the car showed no warning lights. After the accident, I had the vehicle inspected at the Hyundai dealership. The dealership stated they could not reproduce the failure and “found no issues,” which contradicts the symptoms. Since the crash, I discovered two Hyundai Technical Service Bulletins that directly match the failure I experienced: TSB 23-01-036H-1 (Relates to HECU/Electronic Parking Brake failure) TSB addressing DTC C1620 (Relates to FCA Sensor/Automatic Braking malfunction) These TSBs relate to brake assist malfunction, emergency brake concerns, and similar stopping failures. The dealership did not disclose these TSBs, did not apply the corrective procedures, and cleared the car as having “no defects.” The dealership wrote “could not reproduce concern” and “no problems found,” despite the vehicle having just been in a brake-failure crash. This brake failure created a major safety risk with potential for severe injury or fatality. I am reporting this because the defect appears unresolved, the dealership denied it, and the TSBs show Hyundai is aware of brake-related issues. I request that NHTSA investigate this brake-system failure as part of a potential manufacturer safety defect. The vehicle is currently secured at the dealership (Lithia Hyundai, Las Vegas) and is available for inspection upon request by NHTSA investigators.

On June 13 2023, I received an alert on my dashboard that my cruise control was unable to be used due to an issue with the front sensor. The alert went away soon after but then reappeared on August 27th, 2023 the error appeared again. Specifically error code C162078. I wasn't able to get the issue repaired until November 2023, which is also where they replaced my faulty backup camera.

While traveling on a bridge with a very steep incline, the forward safety system light came on, which disabled the cruise control. We could not resolve the warning light issue, despite taking it thru a car wash, hoping that the sensor was just dirty. The warning light remained on for several days, then went away. One month later, on a sunny, dry day, the light returned. I made an appt at the local dealership, where the car was purchased and they told me that the front sensor was out of alignment and I most likely hit something, which I did not. $370 for the alignment and since they assumed I hit something, it voided the warranty.

Check foward safety feature dashlight came on while driving, my blue link app told me the DTC c162078 chassis alignment failed front radar On Jun 4th 2024 while in park and idle my steering wheel kept going side to side, I recorded it not sure if that had something to do with this happening on July 2, 2024 and my safety is in jeopardy I feel due to the forward collision not working, smart cruise control not working, made appointment at hyundai dealership and I showed them the code bluelink told me to show them and they said they have to diagnose car themselves and the cost would be $169.99. I had to call hyundai customer care and get a claim number because dealership said they had to charge me. Two days i waited for dealership to call me the lady stated to let dealership know to waive diagnostic fee, I was told they would waive fee but I would need to pay $497 for part and $500 for labor which includes labor and recalibration, I told them I am financing a car I don't have safety features for, so I believe this should be listed as a recall or it should be fixed free of charge, being this is no fault of my own. No accident, didn't hit anything , I was driving at night and smooth roads. Dealership wanted me to lie to my insurance company and say I hit pothole. I told her no because that would be a lie.

Hyundai Motor America (Hyundai) is recalling certain 2021-2022 Santa Fe, Santa Fe HEV, Elantra, Elantra HEV and 2022 Elantra N and Santa Fe PHEV vehicles. Due to a damaged printed circuit board, the rearview camera image may fail to display. As such, these vehicles fail to comply with the requirements of Federal Motor Vehicle Safety Standard number 111, "Rear Visibility."

Consequence & remedy

Consequence: A rearview image that does not display reduces the driver's visibility and increases the risk of a crash.

Remedy: Dealers will replace the rearview camera, free of charge. Owner notification letters were mailed January 14, 2025. Owners may contact Hyundai customer service at 1-855-371-9460. Hyundai's number for this recall is 271.

Hyundai Motor America (Hyundai) is recalling certain 2022 Elantra N and 2022-2023 Elantra vehicles. The emblem on the cover of the driver's front air bag may not have been welded properly, which can result in the emblem detaching upon deployment.

Consequence & remedy

Consequence: A detached air bag cover emblem may strike a vehicle occupant, which can increase the risk of injury.

On August 8, 2022, the Office of Defects Investigation (ODI) opened this Recall Query (RQ) based on 3 incidents alleging front seat belt pretensioners that may rupture during deployment, on model year (MY) 2020-2022 of various Hyundai and Kia Models, resulting in 3 injuries (note: one incident occurred outside the U.S. and its territories).Between October 2021 and March 2023, Hyundai and Kia have filed the following 11 safety recalls for pretensioner rupture: NHTSA Recall No. 21V-796, 22V-069, 22V-123, 22V-127, 22V-218, 22V-354, 22V-447, 22V-458, 22V-816, 23V-094, and 23V-210.Hyundai/Kia have stated that the abnormal deployment of the pretensioners is due to over-pressurization of the pretensioner pipe that can cause metal fragments to enter the vehicle occupant compartment, which can result in injury to vehicle occupants.The various makes/models covered by the above recalls include approximately 405,900 certain 2020-2022 Hyundai Accent, 2021-2022 Hyundai Elantra and Elantra HEV, 2021-2022 Hyundai Santa Fe HEV, 2022-2023 Hyundai Santa Fe PHEV, 2020-2022 Hyundai Venue, 2021-2023 Genesis G80, 2023 Genesis G80 EV, 2023 Genesis G90, 2023 Genesis GV60 EV, 2022-2023 Genesis GV70, 2021-2023 Genesis GV80, 2021-2022 Kia Sorento HEV, and 2022 Kia Sorento PHEV.In response to ODI's investigation, in December 2022, Hyundai notified ODI that they would be conducting testing to validate subject vehicle seat belt pretensioners. This evaluation included sled testing and software testing which was performed by Hyundai and its suppliers. The tests were intended to evaluate pretensioner deployment characteristics based on the unique deployment signature of the subject and peer vehicles. ODI met with representatives from Hyundai on several occasions during the investigation to discuss testing progress and data. As a result of the testing, Hyundai was able to simulate the pretensioner failures. It was determined by Hyundai during testing, the front driver-side and/or passenger-side seat belt pretensioners may explode upon deployment in the event of a crash which can cause metal fragments to enter the vehicle occupant compartment.Hyundai thus notified ODI of their decision to proceed with a safety recall, to expand the scope of the previous safety actions.In view of the recall actions taken by Hyundai and Kia, ODI concerns have been addressed. The agency reserves the right to take additional action if warranted by future circumstances.

ODI met with representatives from Hyundai on several occasions during the investigation to discuss testing progress and data. As a result of the testing, Hyundai was able to simulate the pretensioner failures. It was determined by Hyundai during testing, the front driver-side and/or passenger-side seat belt pretensioners may explode upon deployment in the event of a crash which can cause metal fragments to enter the vehicle occupant compartment.Hyundai thus notified ODI of their decision to proceed with a safety recall, to expand the scope of the previous safety actions.In view of the recall actions taken by Hyundai and Kia, ODI concerns have been addressed.
