WE MADE A PURCHASE OF BRAND NEW NISSAN ROGUE SV YESTERDAY 06/24/2018. UNFORTUNATELY WE DIDN'T GET A CHANCE TO BRING OUR BRAND NEW VEHICLE AT HOME TODAY AS WE GOT MALFUNCTION WARNINGS 2 TIMES WITH SUDDEN AUTOMATIC BRAKES BY THAT VEHICLE'S AUTOMATIC BREAKING SYSTEM(ABS)AND LOUD MALFUNCTION WARNING NOISE WITHIN IN 4 MILES OF DRIVING FROM NISSAN DEALERSHIP. NISSAN DEALER TOLD US THAT HE WILL ASK HIS TECHNICIAN TO LOOK AT IT TOMORROW AND FIND OUT THE CAUSE OF THAT MALFUNCTION WARNING. BUT AS OF NOW, I HAVEN'T RECEIVED ANY ANSWER FROM THEM. DUE TO THIS, I FEEL VERY UNSAFE, UNCOMFORTABLE AND SCARED TO DRIVE THAT VEHICLE AGAIN AS I DROVE THAT VEHICLE FOR JUST 4 MILES BEFORE WE TURNED THAT VEHICLE TO DOWNEY NISSAN DEALER AGAIN IN LESS THAN 30 MINUTES OF OUR PURCHASE FOR REPAIR.

AT LEAST 6 TIMES THE AUTOMATIC EMERGENCY BRAKING HAS ENGAGED WHEN THERE WAS NO VEHICLE OR OBSTACLE IN FRONT OF THE CAR.IN EACH OF THESE INCIDENTS THE WARNING LIGHT FLASHED BRIEFLY, THERE WAS A BEEP ,THE BRAKES ENGAGED AND THERE WAS A GRINDING SOUND, BUT THE CAR NEVER STOPPED. THE FIRST 4 TIMES IT OCCURRED WHILE DRIVING IN THE RIGHT LANE OF A 3 LANE CITY STREET APPROACHING THE ENTRANCE TO A PARKWAY. ON 2 OF THOSE OCCASIONS I HAD JUST STOPPED AT A TRAFFIC LIGHT AND WAS PROCEEDING SLOWLY WHEN THE BRAKES ENGAGED THERE WERE NO CARS IN FRONT OF ME OR BEHIND OR I COULD HAVE BEEN REAR ENDED. MY DAUGHTER WAS IN THE FRONT PASSENGER SEAT. SO I MADE A SERVICE APPOINTMENT WITH THE DEALER ON APRIL 4, 2018 , THEY TOOK A TEST DRIVE WITH ME PRESENT AND THEN CONDUCTED A COMPUTER DIAGNOSTIC TEST TO SEE IF ANY ERROR MESSAGES SHOWED UP , NONE DID. NO SERVICE REPORT WAS FILED AT THE TIME .FOR SEVERAL WEEKS AFTER THE PROBLEM DID NOT SURFACE UNTIL LAST NIGHT 6/21 WHEN I WAS DRIVING ON A LOCAL CITY STREET AND A CAR CAME OUT OF SIDE STREET TO CROSS IN FRONT OF MY CAR IT WAS ABOUT A 1/3 OF A BLOCK IN FRONT OF ME AND THE BRAKES ENGAGED . THIS IS A BRAND NEW CAR WHICH WE GOT ON 1/31/2018 . THE MAJORITY OF THESE INCIDENTS OCCURRED DURING FEBRUARY, MARCH ANN NOW JUNE , THE VEHICLE HAS LESS THAN 5,000 MILES ON IT.

THREE TIMES THE AUTOMATIC BRAKING SYSTEM HAS ENGAGED WHEN THERE WAS NO VEHICLE OTHER OBSTACLE NEAR OR IN THE CAR'S PATH. ALL THREE TIMES, THE WARNING LIGHT FLASHED, THERE WAS A BEEP, AND THE BRAKE'S ENGAGED AND THERE WAS A GRINDING SOUND AND THE CAR PULLED TO THE RIGHT. FIRST TWO TIMES IT OCCURRED AS I WAS DRIVING UP A RAMP IN A PARKING GARAGE. AS I REACHED THE CREST OF THE RAMP, THE BRAKES ENGAGED AND CAR SLOWED. IF ANYONE HAD BEEN BEHIND, I'D HAVE BEEN REAR-ENDED. THERE WERE NO CARS IN FRONT OF ME OR ALONGSIDE. THE THIRD OCCURRENCE WAS ON TWO LANE ROAD COMING THROUGH A TRAFFIC LIGHT -- NO CARS IN FRONT OR IN THE INTERSECTION AND SUDDENLY THE CAR BRAKED AS WELL AS BEEPED. I TALKED TO DEALERSHIP ABOUT THE FIRST TWO INCIDENTS AND THEY TOLD ME THEY KNEW OF NO ISSUES SO OF COURSE DID NOTHING. THIS IS A NEW CAR WHICH I GOT ON MARCH 24 2018. THESE INCIDENTS OCCURRED IN APRIL, MAY AND JUNE. CAR CURRENTLY HAS 4500 MILES ON IT.

ON MAY 31, 2018, I WAS DRIVING AT ABOUT 50 MPH ON A 4 LANE ROAD WITH NO CARS BEHIND ME, AND THE NEAREST CAR IN FRONT OF ME ABOUT A MILE AHEAD. SUDDENLY MY CAR CAME TO A FULL AND COMPLETE STOP AND THEN PROCEEDED AT ABOUT 5 MPH. THIS WAS ACCOMPANIED BY TWO WARNING BEEPS AND A SEVERE GRINDING NOISE. AT NO TIME WAS MY FOOT ON THE BRAKE. I HAD THE CAR TOWED TO MY DEALERSHIP, BUT THEY COULD FIND NOTHING WRONG, NOR COULD THEY DUPLICATE THE PROBLEM. I CALLED THEIR NATIONAL CONSUMER HOTLINE, BUT THEY SAID THEY HAVE NEVER HEARD ABOUT THE PROBLEM. A QUICK SEARCH ON GOOGLE REVEALS THAT THERE ARE MANY COMPLAINTS ON THIS ISSUE.

ON 2-3-18, I BOUGHT A NEW 2018 NISSAN ROGUE FROM ED HICKS NISSAN IN CORPUS CHRISTI, TEXAS. THIS CAR HAD A HANDS FREE SYSTEM THAT ALLOWED CALLS TO BE MADE AND ANSWERED WITHOUT TOUCHING THE PHONE. IT WORKED WHEN WE BOUGHT THE CAR. IN LATE FEBRUARY, THE CALLING PORTION OF THE SYSTEM FAILED. WE ARE UNABLE TO PLACE CALLS WITHOUT DIALING THE NUMBER THROUGH THE PHONE. THE HANDS FREE SYSTEM DOES NOT WORK AS ADVERTISED. WE ARE UNABLE TO COMPLY WITH THE HANDS FREE LAWS OF THE CITY OF CORPUS CHRISTI EVEN THOUGH WE WERE ASSURED WE COULD WHEN WE BOUGHT THE CAR. THE DEALER HAS BEEN UNABLE TO FIX THE PROBLEM WHICH THEY NOW SAY DISABLES THE HANDS FREE SYSTEM IN MOST 2018 ROGUES. THEY SUGGESTED THAT I COMPLAIN TO NISSAN, WHICH I HAVE. MY NISSAN CASE NUMBER IS 30966074. MY ORIGINAL COMPLAINT WAS ESCALATED TO A YOUNG MAN NAMED ZACHRY. HIS PHONE NUMBER IS 615-725-7633. HE WAS VERY NICE BUT PROVIDED NO ANSWERS. NOW HE WON'T RETURN MY CALLS. I LEFT MESSAGES LAST FRIDAY, 5-11-18 AND MONDAY, 5-14-18. HE HAS FAILED TO RETURN MY CALLS. I ASKED THE DEALER TO REPLACE THE SYSTEM UNDER MY WARRANTY. THE SERVICE MANAGER, ROBERT TREVINO 361-227-5771, SAYS NISSAN WILL NOT AUTHORIZE THE REPAIR. I AM AT MY WITS END. NISSAN WILL NOT FIX THE PROBLEM OR REPLACE THE BAD UNIT WITH A NEW ONE AS IT SHOULD UNDER WARRANTY. I AM UNABLE TO COMPLY WITH THE LAWS OF THE CITY OF CORPUS CHRISTI AND AM PLACED IN THE POSITION OF BEING A DISTRACTED DRIVER IF I HAVE TO MAKE A CALL WHILE DRIVING. I ASK THAT YOU FORCE NISSAN TO REPAIR OR REPLACE THE HANDS FREE SYSTEM OF MY VEHICLE BEFORE I INJURE MY SELF OR SOMEONE ELSE.

PE19010 · False Automatic Emergency Braking

Opened Sep 9, 2019 · No close date supplied

Status: open (inferred from source dates) · Forward Collision Avoidance: Automatic Emergency Braking

NHTSA received a defect petition (DP19-001) from the Center for Auto Safety (CAS) on March 21, 2019 alleging that the Automatic Emergency Braking (AEB) system on Model Year (MY) 2017-2018 Nissan Rogue and Rogue Sport vehicles was engaging in cases where there was no obstruction in the path of the vehicle. The CAS petition additionally alleges that, based on Nissan's actions, the manufacturer is aware of the issue due to issuing a Technical Service Bulletin (TSB) launching two "Quality Actions," and initiating a "Customer Service Initiative" in relation to it. CAS contends that Nissan's actions do not represent an adequate long-term solution to the problem, as the action is only available during the basic coverage period of the warranty. CAS also argues that the alleged failures are an unreasonable risk to safety and views Nissan's communications as not acknowledging the potential safety issue involved, instead treating the alleged problem as a performance update. The Office of Defects Investigation (ODI) analyzed Vehicle Owner Questionnaire (VOQ) complaints received from consumers and identified a total of 129 unique subject vehicle reports (for all submission dates) alleging a false positive triggering of AEB. Of these complaints, three were identified that contained allegations of a collision resulting from the activation of the system, and all three indicating related injuries. In response to ODI's April 15, 2019 Information Request letter, Nissan provided data indicating that it has received 750 unique subject vehicle complaints relating to false positive activation of the AEB system. Of these complaints, 12 were identified that contained allegations of a collision resulting from the activation of the system. Four complaints contained allegations of injuries, three of which were the result of a collision. These complaints included duplicates of complaints that ODI received. The injury allegations were limited to soft tissue type injuries such as whiplash and bruising.Based on its review of the information identified to date, ODI has granted the petition and is opening this preliminary evaluation in order to evaluate the cause, scope and frequency of AEB false positive activations, as well as to evaluate the suitability of the manufacturer's campaign to address the concern or improve performance of the AEB system. The complaints cited can be viewed at NHTSA.gov under the following ODI identification numbers: 11230875, 11230481, 11230361, 11229400, 11229302, 11229294, 11228994, 11223074, 11222925, 11222644, 11220499, 11218713, 11218608, 11217157, 11210334, 11210256, 11210148, 11209127, 11209032, 11207333, 11205931, 11205717, 11205661, 11205172, 11205124, 11205027, 11204803, 11204349, 11204324, 11196805, 11196561, 11196466, 11196091, 11195938, 11195574, 11194380, 11193989, 11192761, 11192283, 11192063, 11190855, 11190840, 11189976, 11187374, 11186903, 11185890, 11185883, 11185132, 11183406, 11180813, 11174713, 11173666, 11173302, 11172299, 11171331, 11170989, 11165434, 11164646, 11162898, 11162502, 11162396, 11161413, 11161230, 11155985, 11155209, 11155181, 11154181, 11153607, 11153334, 11151373, 11151028, 11142595, 11142557, 11142386, 11141775, 11141433, 11141387, 11141347, 11140604, 11139711, 11139226, 11133402, 11132376, 11130998, 11130662, 11129949, 11128704, 11124099, 11123564, 11123353, 11123321, 11122783, 11119475, 11119300, 11118604, 11115088, 11113479, 11113371, 11112371, 11111659, 11111057, 11110919, 11110689, 11104075, 11103844, 11103437, 11102715, 11102333, 11100117, 11099313, 11091006, 11089960, 11089798, 11089533, 11088815, 11088718, 11081072, 11079453, 11073644, 11072718, 11065505, 11061598, 11057739, 11056061, 11055766, 11048349, 11035301, 11033225, and 10972343.
