I'VE A FULLER VERSION OF THIS, IF NEEDED.*DT *DT*DT*DT*DT*JB*DT*DT*DT *TP DETAILS: ON 12/16/19, I CAME HOME AROUND 4:45PM. IT WAS RAINING & ALMOST DARK. MY SON WAS IN BACKSEAT & I WAS DRIVING. I PARKED AT THE TOP OF MY DRIVEWAY, FRONT 1ST. (THE DRIVEWAY IS LONG/SLOPED, BUT EVENS AT THE TOP, STILL SLIGHTLY ANGLED.) I PUT THE CAR INTO PARK, PRESSED THE PARKING BREAK (PER HABIT), AND, LEAVING THE CAR COMPLETELY ON, I UNLOCKED MY HOME'S DOOR. MY SON WAS IN THE CAR, LISTENING TO A SONG, AS I GOT THE TRASH CANS/MAIL FROM THE CURB. (THIS ALL TOOK 5 MINS, THUS, I KNOW THAT THE CAR WAS IN PARK, NOT NEUTRAL OR REVERSE.) I OPENED THE FRONT PASSENGER DOOR & TOLD MY SON TO GO IN THE HOUSE. STANDING ON MY DRIVEWAY, I GOT MY BAGS & REACHED ACROSS TO PRESS THE KEYLESS START BUTTON. AS SOON AS I DID, THE CAR BEGAN TO ROLL BACKWARDS AND HIT A TREE. THE CAR DOOR PUSHED ME DOWN THE DRIVEWAY. THANKFULLY, I WAS ABLE TO GET LEAP FREE, JUST AS THE CAR REALLY PICKED UP SPEED. IT FINALLY CRASHED INTO A TREE IN MY NEIGHBOR'S YARD, LANDING OVER A DRAINAGE DITCH B/W OUR HOMES. THERE WERE ONLY MINOR INJURIES. THE CARSEAT HEADREST BROKE. THE VISIBLE CAR DAMAGE IS ON THE REAR BUMPER/LIFTGATE AND THE PASSENGER DOOR. SHAKEN, I DIDN'T THINK TO TAKE PHOTOS OR CALL THE POLICE. AS I AWAITED A TOW TRUCK, I DID NOT ACCESS THE CAR: IT WAS OVER THE DITCH, IN MUD AND RAIN, W/ 1 WHEEL SUSPENDED IN AIR. WHEN THE TOW DRIVER HAD ME GET IN TO HELP HIM MOVE IT, AND I FOUND THE PARKING BREAK DEPRESSED AND THE CAR IN PARK. THE TOW-TRUCK DRIVER MAY BE ABLE TO VERIFY THIS. (THE PARKING BRAKE WAS NOT COMPLETELY PRESSED TO THE FLOOR. MAYBE HALFWAY.) *TP I HAVE FILED A REPORT WITH NISSAN. WHILE THE VEHICLE WAS IN MOTION DRIVING STRAIGHT AT APPROXIMATELY 30 MILES PER HOUR, AT 7:52AM ON UNIVERSITY BLVD AT HIGHWAY 75, THE AUTOMATIC EMERGENCY BRAKING SYSTEM ENGAGED FOR NO REASON CAUSING THE VEHICLES BRAKES TO INAPPROPRIATELY ENGAGE. THIS WAS A FAILURE OF THE AUTOMATIC EMERGENCY BRAKING SYSTEM DUE TO THE RANDOM NATURE AND THE FACT THERE WAS NO HAZARD OR CONDITION REQUIRING THE AUTOMATIC EMERGENCY BRAKING TO BECOME ENGAGED. THIS IS NOT THE FIRST TIME THIS HAS HAPPENED AND AT LEAST ONE PREVIOUS SAFETY COMPLAINT HAS BEEN ENTERED. THIS FAILURE OF THE AUTOMATIC EMERGENCY BRAKING SYSTEM DO CAUSE THE VEHICLE TO STOP AND IS A VERY SERIOUS SAFETY CONCERN.

EMERGENCY BRAKING SYSTEM IS BREAKING BY ITSELF SPECIFICALLY ON HIGHWAY SPEEDS CONSISTENTLY AFTER ~1 HOUR INTO A TRIP. FIRST, BROUGHT THE VEHICLE TO BE FIXED AROUND TWO MONTHS AGO AFTER MULTIPLE BREAKING ATTEMPTS AT HIGHWAY SPEEDS. ALMOST CAUSED A CRASH BECAUSE MY CAR STARTED BREAK CHECKING PEOPLE BEHIND ME. THE BREAKS KICK ON FOR AROUND A SECOND, THEN KICK OFF. THIS HAPPENS AROUND TWICE, WHICH THEN THE CAR SAYS THE FRONT RADAR IS BROKEN AND TURNS THE SYSTEM OFF. AFTER BRINGING IT IN THE FIRST TIME, SAME RESULTS HAPPENED. BROUGHT IT IN A SECOND TIME EARLIER THIS WEEK. TECH CONFIRMED SYSTEM ERRORS WITH "C1A16 CODES". DROVE IT AFTER BRINGING IT IN A SECOND TIME, AND SAME PROBLEM IS OCCURRING.

EVENTUALLY THE LIVE VIEW WOULD COME BACK, BUT I COULD NEVER TRUST THE SCREEN OR THE SENSORS WHILE BACKING UP. I RECENTLY TOOK IT INTO A DEALERSHIP FOR A DIAGNOSTIC, AND THEY SAID THERE IS AN UPDATE AVAILABLE TO THE SOFTWARE TO FIX IT. I WOULD GUESS MY CAR IS NOT THE ONLY ONE WITH THIS PROBLEM AND WANT TO REPORT THIS SO THAT IF OTHERS ARE HAVING THE SAME PROBLEM, THE SOFTWARE UPDATE CAN BE COVERED BY NISSAN. SIMILAR NISSAN/INFINITI MODELS ARE DOING A RECALL FOR A SOFTWARE UPDATE TO THE CAMERAS; I'M NOT SURE WHY MY VIN IS NOT INCLUDED IN THAT CAMPAIGN.

ABOUT 2 MONTHS AFTER FIXING A RECALL ON THE AEB SYSTEM ON MY 2018 NISSAN ROGUE, MY CAR'S AEB SYSTEM ENGAGED WHILE DRIVING 75 MPH ON THE INTERSTATE CAUSING MY VEHICLE'S ANTILOCK BRAKES TO KICK ON AND BEEP A WARNING TO SLOW DOWN BECAUSE MY CAR'S SENSOR BELIEVED SOMETHING WAS IN FRONT OF ME. THERE WAS NOTHING IN FRONT OF ME FOR MILES AND FORTUNATELY, NO ONE WAS BEHIND ME TO SLAM IN TO ME. MY LOCAL DEALERSHIP STATED THAT THE PROBLEM WAS A FAULTY ICC SENSOR, WHICH WORKS COMPLEMENTARY WITH THE VEHICLE'S AEB SYSTEM. FORTUNATELY, IT WILL ONLY COST ME THE $100 DEDUCTIBLE ON MY EXTENDED WARRANTY BECAUSE AT 52K MILES, I'M OVER WARRANTY, BUT NISSAN NEEDS TO CORRECT THIS PROBLEM TO BE A SAFETY ISSUE AND FIX REGARDLESS OF THE MILEAGE ON EACH VEHICLE.

THEN IT HAPPENED AGAIN AND I WAS ON A SIDE STREET GOING 40 MPH AND IT BRAKED TO 30 AND THERE WASN'T ANYTHING IN FRONT OF ME. I DON'T WANT TO DRIVE THIS CAR AT ALL. I WANT THEM TO JUST TAKE IT BACK. PE19010 · False Automatic Emergency Braking

Opened Sep 9, 2019 · No close date supplied

Status: open (inferred from source dates) · Forward Collision Avoidance: Automatic Emergency Braking

NHTSA received a defect petition (DP19-001) from the Center for Auto Safety (CAS) on March 21, 2019 alleging that the Automatic Emergency Braking (AEB) system on Model Year (MY) 2017-2018 Nissan Rogue and Rogue Sport vehicles was engaging in cases where there was no obstruction in the path of the vehicle. The CAS petition additionally alleges that, based on Nissan's actions, the manufacturer is aware of the issue due to issuing a Technical Service Bulletin (TSB) launching two "Quality Actions," and initiating a "Customer Service Initiative" in relation to it. CAS contends that Nissan's actions do not represent an adequate long-term solution to the problem, as the action is only available during the basic coverage period of the warranty. CAS also argues that the alleged failures are an unreasonable risk to safety and views Nissan's communications as not acknowledging the potential safety issue involved, instead treating the alleged problem as a performance update. The Office of Defects Investigation (ODI) analyzed Vehicle Owner Questionnaire (VOQ) complaints received from consumers and identified a total of 129 unique subject vehicle reports (for all submission dates) alleging a false positive triggering of AEB. Of these complaints, three were identified that contained allegations of a collision resulting from the activation of the system, and all three indicating related injuries. In response to ODI's April 15, 2019 Information Request letter, Nissan provided data indicating that it has received 750 unique subject vehicle complaints relating to false positive activation of the AEB system. Of these complaints, 12 were identified that contained allegations of a collision resulting from the activation of the system. Four complaints contained allegations of injuries, three of which were the result of a collision. These complaints included duplicates of complaints that ODI received. The injury allegations were limited to soft tissue type injuries such as whiplash and bruising.Based on its review of the information identified to date, ODI has granted the petition and is opening this preliminary evaluation in order to evaluate the cause, scope and frequency of AEB false positive activations, as well as to evaluate the suitability of the manufacturer's campaign to address the concern or improve performance of the AEB system. The complaints cited can be viewed at NHTSA.gov under the following ODI identification numbers: 11230875, 11230481, 11230361, 11229400, 11229302, 11229294, 11228994, 11223074, 11222925, 11222644, 11220499, 11218713, 11218608, 11217157, 11210334, 11210256, 11210148, 11209127, 11209032, 11207333, 11205931, 11205717, 11205661, 11205172, 11205124, 11205027, 11204803, 11204349, 11204324, 11196805, 11196561, 11196466, 11196091, 11195938, 11195574, 11194380, 11193989, 11192761, 11192283, 11192063, 11190855, 11190840, 11189976, 11187374, 11186903, 11185890, 11185883, 11185132, 11183406, 11180813, 11174713, 11173666, 11173302, 11172299, 11171331, 11170989, 11165434, 11164646, 11162898, 11162502, 11162396, 11161413, 11161230, 11155985, 11155209, 11155181, 11154181, 11153607, 11153334, 11151373, 11151028, 11142595, 11142557, 11142386, 11141775, 11141433, 11141387, 11141347, 11140604, 11139711, 11139226, 11133402, 11132376, 11130998, 11130662, 11129949, 11128704, 11124099, 11123564, 11123353, 11123321, 11122783, 11119475, 11119300, 11118604, 11115088, 11113479, 11113371, 11112371, 11111659, 11111057, 11110919, 11110689, 11104075, 11103844, 11103437, 11102715, 11102333, 11100117, 11099313, 11091006, 11089960, 11089798, 11089533, 11088815, 11088718, 11081072, 11079453, 11073644, 11072718, 11065505, 11061598, 11057739, 11056061, 11055766, 11048349, 11035301, 11033225, and 10972343.
