THIS IS MY 2ND NHTSA COMPLAINT (FIRST #10510406). I HAVE VIDEOS DOCUMENTING PROBLEM, TO WHICH INIFINITI'S RESPONSE WAS (PRIOR TO MOST RECENT OFFICIAL RECALL IN 04/2014) "WE ARE NOT SITTING IN THE SEAT PROPERLY". I WAS THRILLED TO HEAR ABOUT THE 2014 RECALL THINKING "FINALLY!", BUT I HAVE HAD IT APPLIED TO MY VEHICLE, TWICE NOW, AND I STILL HAVE THE SAME ISSUE OF THE LIGHT COMING ON AT TIMES. IT HAS BEEN WITH ADULTS WEIGHING 115-130LBS AND AS I WATCH THE INFINITI VIDEO (HTTP://WWW.YOUTUBE.COM/WATCH?V=OY1QVNAMXSS&SNS=EM) I SEE THEY ARE SAYING IT TURNS OFF FOR THE SAFETY OF SMALL 'ADULT' PASSENGERS. I WISH THEY WOULD DEFINE "SMALL" IN POUNDS; IF 120 DOESN'T QUALIFY, THEY SHOULD HAVE NEVER SOLD ME THE CAR SINCE I'M CONSTANTLY AT RISK IN MY OWN SEAT! AIRBAGS ARE NOT NEW TECH. THEY NEED TO GUT WHATEVER NEW TECH THEY TRIED AND GO BACK TO A KNOWN ENTITY. I COULD LIVE (NO PUN INTENDED - BUT IRONIC) WITH IT BEING FLAKY AND TURNING OFF BECAUSE A PASSENGER MOVES AROUND IN THEIR SEAT - IF IT WOULD ONLY TURN BACK ON WHEN THEY WERE SITTING PROPERLY AGAIN! BUT, 1) MY PASSENGERS ARE SITTING PROPERLY TO BEGIN WITH, AND 2) WHEN THEY TRY AND LIFT OFF THE SEAT AND BACK DOWN AGAIN IN HOPES OF TURNING THE AIRBAG BACK ON, IT DOES NOT HELP. ONLY STOPPING THE CAR RESOLVES THE ISSUE. THIS IS HIGHLY PROBLEMATIC BECAUSE IT HAPPENS WHILE GOING DOWN THE HIGHWAY AND THERE'S NO WAY TO RESET IT SHORT OF STOPPING THE CAR OR WAITING IT OUT. ANYONE WHO SITS IN MY FRONT PASSENGER SEAT KNOWS THEY ARE BEING USED AS A TEST DUMMY AND TO SIT PROPERLY BECAUSE I WARN THEM THIS AIRBAG ISSUE CAN HAPPEN. IT'S PREPOSTEROUS. I'VE OWNED AUDI, LEXUS, TOYOTA, MAZDA, HONDA, AND BMW AND NEVER HAD AN AIRBAG ISSUE LIKE THIS. INFINITI IS COVERING UP A DEFECTIVE SYSTEM THAT NEEDS TO BE COMPLETELY REPLACED. RATHER THAN PROCEED INTO THE INTERSECTION (WITH TRAFFIC TRAVELING ON ESSEX STREET) I IMMEDIATELY TURNED THE WHEEL TO THE LEFT TO GO UP ON AN ISLAND TO STOP THE VEHICLE. WE DROVE TO THE DEALERSHIP/SERVICE AND THE SERVICE MANAGER WITNESSED MY WIFE SITTING CORRECTLY IN THE FRONT PASSENGER SEAT AND THE "PASSENGER AIRBAG OFF" LIGHT ILLUMINATED. WE WERE GIVEN ANOTHER LOANER JX35 AND TOLD THAT THEY WOULD HAVE TO LOOK INTO IT MORE. WHILE DRIVING MY WIFE AROUND IN THIS LATEST JX35 I HAVE NOT HAD THE SAME ISSUE. I HAVE TAKEN MY JX35 IN NOW FOUR TIMES FOR THE SAME ISSUE. I HAVE BEEN LOANED THREE JX35'S AND AM NOT EXPERIENCING THE SAME ISSUE IN THEM WITH MY WIFE IN THE PASSENGER SEAT. THERE IS A KNOWN RECALL FOR THIS EXACT ISSUE BUT MY VEHICLE'S VIN CODE IS NOT LISTED AS BEING UNDER THE RECALL. Nissan is recalling certain model year 2013 Pathfinder and Infiniti JX vehicles manufactured December 3, 2012, through January 29, 2013. The front brake torque member was improperly cast resulting in structural weakness. This can lead to premature failure and cracking.

Consequence & remedy

Consequence: If the brake torque member fails, the brake caliper may move and contact the inside of the road wheel, resulting in reduced braking, increasing the risk of a crash.

Remedy: Nissan will notify owners, and dealers will inspect the manufacturing date of the torque members and replace them, as necessary, free of charge. The recall began on May 20, 2013. Owners may contact Nissan Customer Service at 1-800-647-7261.

On March 25, 2014, Nissan North America (Nissan) submitted a Defect Information Report to NHTSA describing a defect of inadequate hose clamping force that may result in the internal transmission oil cooler (ITOC) hose detaching from the cooler.According to Nissan, transmission fluid leakage from a detached ITOC hose results in a progressive series of symptoms beginning with malfunction indicator lamp (MIL) illumination, followed by noise and vibration and culminating in loss of power due to transmission failure.Many of the incident vehicle drivers interviewed by ODI indicated that the loss of power occurred soon after the first symptoms were observed.The recall covers approximately 3,065 Pathfinder vehicles built from the start of MY 2013 production on April 18, 2012, through October 3, 2012, when Nissan implemented several production improvements to address concerns with ITOC hose detachment.Infiniti JX vehicles investigated in PE13-029 are not included in the recall as they are equipped with a different CVT transmission with a lower operating pressure.Owners of all potentially affected vehicles will be notified within 60 days to take their vehicles to a Nissan dealer.The dealer will install an oil hose repair kit at no charge to owners.ODI's analysis of failure data for the 3,065 Pathfinder vehicles that are included in Nissan's recall identified 12 Vehicle Owner Questionnaires (VOQs), 134 Nissan complaints and field reports and 259 warranty claims.This equates to a complaint/field report rate of 47.6 incidents per thousand vehicles (IPTV) and a warranty claim rate of 8.5 percent.The failure rates for the 120,474 subject vehicles that are not included in the recall are much lower, with complaint rates of 0.4 and 0.8 IPTV and warranty claim rates of 0.1 and 0.2 percent for the remaining MY 2013 Pathfinder and JX vehicles, respectively.This investigation is closed.The VOQ numbers associated with this closing are: 10558389, 10556011, 10546402, 10545032, , 10531793, 10509314, 10507077, 10503884, 10500834, 10499362, 10497685, 10496606, 10494583, 10493759, 10493701, 10490959.
